Trading Terms and Conditions

Welcome to the e-commerce service website www.techmaster.com.vn , this is an electronic website set up and owned by Techmaster Electronics Joint Stock Company, established and operating under license business number: 0312668882 issued on February 28, 2014, by Ho Chi Minh City Department of Planning and Investment. Please read this Terms and Conditions carefully (hereinafter "Terms and Conditions") before ordering any goods / services on the Website (hereinafter "Product"). .

1. Scope of application

1.1. Terms and Conditions applied to customers:

(i) Purchasing the Product on website

(ii) Require to deliver Product to locations in accordance with the Shipping Policy posted on the Website

1.2. Customers in this Terms and Conditions include: all individuals aged 15 and over, having appropriate civil act capacity to conduct transactions through Techmaster and (ii) all established organizations and lawfully operating under the provisions of Vietnamese law (hereinafter referred to as "Customer").

2. Establish and cancel e-commerce contract:

2.1. Establish e-commerce contract

Any information about the Product made on the website in any case is not understood as a recommendation of Techmaster's contract to Customer.

The steps to form a contract are as follows:

Step 1: Customer orders on the website will form an order ("Order"). Immediately, Techmaster sends order notices (order code, recipient information) to Customer (i) directly via website or (ii) via registered email;

Step 2: The Techmaster sends the Order confirmation via one of the following methods:

- Via the email address that the Customer has registered with: Product list, delivery time, contact phone, recipient information, orderer, payment value,…;

- Via the Sales department, directly contact the Customer's phone number with the content: confirm the order code; confirm the successful processing, contact information, order value, delivery time.

- By updating the order status in the Customer account management system on the website with the content of the Order has been confirmed or the content has the same meaning..

- The contract between Techmaster and Customer only establishes and takes effect from the time the Techmaster sends confirmation as stated in Step 2 ("Contract").

(*) Note: In the process of processing Customer's Orders, Techmaster reserves the right not to confirm the Order in the case that includes but is not limited to:

- Techmaster cannot meet the trading conditions in Customer's Orders due to objective reasons, or due to technical errors from the system or the supplier.

Techmaster will update the order status information which is not confirmed in the Customer's account management system on the website for Customer to monitor and receive information..

2.2. Cancel the Order / Cancel the Contract.

2.2.1. Customer has the right to cancel the Order, or cancel the Contract in the following case:

Cancel Before Confirming Orders:

a. For any reason, the Customer has the right to cancel part or all of the order before the time of order confirmation (except for the case which Product apply other special conditions specified by Techmaster), by one or more of the following methods:

b. Techmaster confirms directly by phone, email or update order status (Order canceled) in Customer's account management system.

2.2.2. Techmaster has the right to unilaterally cancel the confirmed Order (Contract) in the following case:

a. Loopholes, system errors, mistakes resulting in deviations in Product information (including but not limited to selling prices, delivery conditions, inventory status, characteristics, types, conditions, incentives attached to the Product) during the process of making Techmaster's purchases of goods in order to receive higher benefits than normal.

b. When encountering a situation of "Force Majeure" affecting the implementation of the Techmaster Contract takes place and extends beyond the time of the occurrence of Force Majeure (eg, Natural disasters, storms, floods, etc.), Techmaster will by all means, making every effort to notify the Customer of this situation and suggest the time for implementation the new Contract. In case Customer does not agree with Techmaster's proposal, either Customer or Techmaster can actively cancel the Contract.

c. Cases where the Techmaster has evidences to determine invalid contracts in accordance with law.

In the event that the order has been confirmed to be partially or completely canceled, the amount of Customer paid in proportion to the value of the canceled order will be refunded to the Customer as prescribed.

3. Prices, VAT invoices and payments

3.1. The price of the Product may include or exclude the value-added tax and is specifically described on the Product introduction page or via direct advice of salesperson to the Customer. In any case, the price of the Product does not include shipping fees. Shipping costs are specified in the Shipping Policy posted on Techmaster’s website.

3.2. Customer has the right to request VAT invoice and receive a valid VAT invoice from Techmaster or supplier (depending on the specific case specified for each Product on website). Customer is responsible for providing complete and accurate VAT invoice information. Techmaster will not assist in making any changes / modifications to VAT invoice information from Customer when the order has been confirmed. The Techmaster may refuse or agree to support the settlement on a case-by-case basis if the Customer requests a VAT invoice after submitting the order as prescribed.

(*) Note: In any case, the Techmaster does not support splitting or merging multiple Orders and issuing VAT invoices for this split or merged order

3.3. Customer pays the value of the order in accordance with the Shipping Policy posted on Techmaster’s website before receiving the Product of that order. When Customer clicks on the "Payment" box to process the order payment, it means that (i) Customer confirms the content of the order information; and (ii) Customer agrees that the terms and conditions will apply to the purchase of Products in that order.

4. Product delivery

4.1. The Product will be delivered to the Customer address requested in the order at the time specified in the Shipping Policy posted on the Techmaster’s website or at the time Customer requests to receive the goods, provided that the delivery time must be consistent with the Shipping Policy.

In case Customer would like to change the receiving address of the Product, Customer must inform Techmaster the name, phone number and address of the person designated by the Customer to receive the Product.

4.2. Regulations on Product check upon delivery are specified in the Shipping Policy posted on the Techmaster’s website

Product risks and ownership will be transferred to the Customer from the time the receiver signs the Delivery List. Customer need to retain delivery notes to control or to solve problems that may arise related to Product (if any).

5. Customer care and complaint solving

5.1. In case of any questions or complaints, including but not limited to the quality of goods / services, Product delivery, attitude of delivery staff, Product exchange / return ... Customer can contact Techmaster by hotline number 028 6266 2333 or email marketing@techmaster.com.vn . When contacting the Customer must provide the order number indicated in the email or message confirming the order that Techmaster sent to Customer. Techmaster will receive and respond to Customer as soon as possible.

5.2. Product warranty:

Product will be warranted (if applicable) in accordance with the policy of the distributor, importer or manufacturer. In any case, Techmaster is not responsible for warranty of Product. Please read and follow the searching instructions, activate the warranty and warranty policy attached to the Product and / or posted on the Website (from time to time). 6. Confidential information

Customer confidential information are implemented in accordance with the Privacy Policy posted on the Techmaster’s website.

7. Limited liability

In any case, Techmaster is not responsible for any damage or loss that Customer has suffered after the time the risk is transferred from Techmaster to Customer, unless caused by Techmaster's fault..

8. General terms

8.1. The provisions referenced in these Terms and Conditions are an integral part of these Terms and Conditions. If there is any inconsistency between these Terms and Conditions and any other provisions regarding the same content, the content of these Terms and Conditions shall prevail..

8.2. Techmaster and Customer when accessing and purchasing goods on the Techmaster’s website means agreeing to perform all obligations stipulated in this Terms and Conditions. Techmaster reserves the right to change, modify, add or remove any part of these Terms and Conditions, from time to time. The changes will take effect immediately after being updated officially on the website and without prior notice, when the Customer continues to make transactions with the Techmaster after changing the Terms and Conditions to take effect, it means the Customer accepts those changes. Once again, Techmaster advises Customer to update regularly or carefully read the Terms and Conditions before making the transaction.

8.3 If any content of these Terms and Conditions is considered invalid by any competent authority or cannot be implemented in whole or in part, then the validity of other content in the Terms and This condition will not be affected.

8.4. These Terms and Conditions and any issues arising in the contractual relationship between Techmaster and Customer will be understood and adjusted in accordance with the laws of Vietnam. Any disputes, differences, complaints arising out of or related to the content of these Terms and Conditions will be resolved through negotiation in good faith within thirty (30) days. If it cannot be resolved within this thirty (30) day period, the above dispute or complaint may be resolved at a competent court.
